Public Comment on Revisions to Proposed New Loc.R.22 Garnishment

The Cleveland Municipal Court has approved for public comment amendments to the Court's Local Rules.  Specifically, the Court has added a proposed new Local Rule 22 Garnishment to improve the efficiency and accuracy of garnishment filings.

The proposed new rule requires parties to use the approved forms on the court's website for filing garnishments, to attach the underlying judgment order to the garnishment affidavit, and for attorneys to use electronic filing.  The rule additionally allows judgment creditors to correct deficiencies in the affidavit within twenty days from the issuance of the Court's notice; the failure to do so, however, will result in dismissal at the judgment creditor’s costs.

The proposed amendments can be viewed by clicking here.

The Court invites public comment on the proposed new rule.  The public comment period opens on October 1, 2026 and closes at 5:00 p.m. on October 31, 2026.  Comments can be sent to publiccomment@cmcoh.org  or may be sent to the Court via regular mail to 1200 Ontario Street, 11th Floor, Cleveland, Ohio 44113.

The Court will be holding a Zoom webinar on the proposed new rule on October 23, 2026 at 1:30 PM eastern. Participants may attend the webinar using Meeting ID 389 551 5389 and Passcode 923067. This session will provide attorneys with essential best practices and tips to navigate this rule effectively. Participants will be encouraged to provide feedback on the proposed new rule.
