The jury year shall begin on the first day of January of each year.  In December of the preceding year, the court shall obtain from the Cuyahoga County Board of Elections, the names of the qualified electors of the City of Cleveland and the Village of Bratenahl from the preceding elections.  From this certified list, the court shall thoroughly intermix and randomly select the names of sufficient prospective jurors for the ensuing year.  The names of prospective jurors shall be entered in a suitable book of record to be known as the “Annual Jury List”.

The names of prospective jurors shall be selected according to the key number to be designated by the administrative judge and in such number that each ward of said territories shall be represented equally proportional to their population.  Automated data processing procedures and visual display apparatus may be utilized in the selection of the names for said compiled list and in the actual compilation of the list.

The names of prospective jurors shall be arranged alphabetically so far as practicable, and under convenient divisions by precincts and districts, and shall be properly indexed.  With each name shall be recorded the place of residence as nearly as the same can be ascertained.  The court may add to said list, or enter on a supplementary list, the names of persons, and their place of residence, who shall thereafter be determined to be qualified to serve as jurors.

The court further authorizes the “Two-Day/One Trial” juror utilization program.  Under this program, the jury commissioner, using data supplied by the judges of the court, shall determine every two working days, the number of jurors that shall be required to handle the cases which are scheduled to go forward.  Jurors for each two-day period, shall have been previously notified by mail of the dates of their jury service and shall be given instructions to call a specific telephone number at the court after 4:00 p.m. on the day before each of the two consecutive days, to determine if it will be necessary for them to physically present themselves to the Jury Commission Department.

The telephone number shall be connected to an answering device containing a taped message, prepared by the jury commission staff, based on the information provided by the court.  The message shall instruct the prospective jurors, by pre-arranged groups, to report to the court for service as required.  If a juror reports and is thereafter selected to serve on a jury, the jury service shall be the duration of the trial for which the juror has been impaneled.

Detailed procedure manuals and outlines relative to juror utilization and selection shall be kept on file in the Administrative Services Department and the Jury Commission Department and they shall be amended and/or modified as required.

These procedures shall neither increase nor diminish the statutory provisions pertaining to jurors as outlined in Ohio Revised Code Chapter 2313.

In the absence of the jury commissioner, the duties outlined under this rule shall be performed by an assistant designated by the commissioner or, in the case of an emergency, the presiding judge.

Withdrawal of jury demand timely made under Ohio Civil Rule 38 or Ohio Criminal Rule 23 must be in writing. Any deposit for costs which has not been used in summoning the jury shall be returned to the depositor. Any additional costs incurred shall be assessed by the court. The withdrawal of jury demand after 2:45 p.m. on the day before trial is untimely and the party will be assessed the full jury cost.
